If the reasons were "poor performance" where is the documentation on that? Performance reviews? A performance improvement plan? The meetings/discussions which usually lead up to termination?

Wrongful dismal is a situation that an employers can only avoid by carefully documenting an employee's deficiencies with written warnings that correction is required, or else.

I think so, and my bet is that they'll "try" to win the wrongful dismisal case by intentionally being poorly prepared. They'll blame the loss on poor lawyers advice, & pay out the $1.7 million while secretly seeing it as a cost of doing business. I expect they don't want any more public revelations.
