There would have to be proof this person was targeted *because* they were trans. The fact that a transgender was killed is not proof they were killed because they were trans. You understand that.

Unfortunately, it's actually quite difficult to prove hate crime charges. It's not enough to prove a crime has been committed. The prosecutor has to show, beyond a reasonable doubt, that the victim was targeted because of some protected characteristic like race, religion, or gender identity. 1/
It's the "reasonable doubt" thing that's the key here. Yes, it is very likely that the victim was targeted because he was trans. But the defendants could claim, "no, I just hated that guy in particular, I didn't give a damn that he was trans." And that would certainly be a reasonable doubt. 2/
Sometimes members of marginalized groups can actually be targeted for crimes that have nothing to do with their membership in that marginalized group. And all that's needed for a defendant to escape a hate crime modifier is that kind of reasonable doubt. 3/
The only way a prosecutor can prove a hate crime is if they have strong evidence establishing motive. They need testimony, texts, online messages, etc. establishing the killers' motives. 4/
That kind of evidence can often be found. But if the killers here never wrote down anything regarding their motives? If none of them agree to testify against the others? In that case, it simply may not be possible to get to the level of proof needed for a hate crime modifier. 5/5

Regardless of the motive, there isn’t enough being said on why so many in the community (cops, social services, motel staff, townies) were able to ignore that a missing person was being held and tortured for >1 month.

They're not saying it cannot be. They just said there's no evidence to support such a statement. They'd have to prove this person was targeted because of their trans status. Awful as it is, people commit heinous violent crimes against others. Not proof they targeted them because of their identity.
