The current ruling technically is for the government to facilitate for his return. If the man’s home country has him imprisoned and refuses to return him to the USA then the government has fulfilled their obligation to the court.

No, we need to stop telling other countries what to do. We've been doing that for the past 100 years and they are sovereign nations. Our task is to get those that we sent there (Kilmar and the Venezuelans) back and give them the due process that the law requires, and stop sending people there.

The Senator should insist on talking to the captive in person. And have some way of verifying that he’s actually talking to the falsely imprisoned person, not some substitute.
