The proposed rule would shorten the marketplace open enrollment period to just 45 days, shorter than the Medicare open enrollment period, and at a time of year when people are pressed for time and budgets are stretched. The rule proposes these changes under the guise of preventing fraud, but punishes enrollees instead of targeting marketplace bad actors. The proposal claims to offer “premium relief to middle class families” but would only help at most a very small proportion of marketplace enrollees who do not qualify for federal premium credits and would actually increase premium and out-of-pocket costs for many enrollees.

The proposal also includes cruel attacks on specific groups: (1) a ban on premium tax credits paying for gender-affirming care; and (2) barring marketplace coverage for certain people who are immigrants by making people with #DACA ineligible for marketplace coverage.
