You can choose a bench (judge) or jury trial. People choose the bench trial if they don’t think they’d get a fair trial by jury.

From what I read it seems he had opted for a bench trial, waiving the right to a jury trial.

It was the defendant's choice to have a trial by judge instead of by jury. He was hoping to find one activist judge, knowing he'd never find twelve activist jurors.
