This is bad, but it could never have been good because the anti-birthright crowd’s underlying theory of citizenship is just atrocious. I want to flag just one bad thing: the brief’s ahistorical butchery of Indian law. 🧵

If anything would move Gorsuch, it would be that. Indian Law is one of the few areas that he consistently sides with the liberal wing of the Court.

IMO it's a way to hold power over state lawmakers and he gets offended that they think he doesn't understand this area of federal law/that they would know it better than he does. So many of his opinions are like "What, do you think I'm stupid?!"

I also think it’s, in some part, just a product of his connection to Colorado. Either through a greater cultural presence, or because of his time on the 10th Cir., or whatever, he’s been forced to reckon with the impact to that community on a personal level more than the court’s other conservatives
