Also, let’s not call this anything other than what it is: less than lethal is effectively just a title to describe it not being an AR15 or firearm. In reality these can be and have been lethal.

This was a shoot to kill. All shots are shoot to kill at that range there is just too much danger.

They think calling the projectile makes it less bad that a cop saw, aimed at and fired upon a journalist. It could have been an airsoft gun and it still would be at minimum assault against a member of the press.

The point is that they shot to kill and disable. At that range the decision to open fire is a lethal one, not just assault; lethal, kill, injure to the effect of disabling or neutralisation.
