It is customary for the expert report to be made available to the opposing party during the court proceedings. However, it is "very unlikely that this will be the case in the short term", say the legal experts.
The Office for the Protection of the Constitution had justified its assessment of the AfD as definitely right-wing extremist with "the extremist character of the party as a whole, which disregards human dignity".

▶️ one might consider that the AfD's announced legal action against the decision of the Office for the Protection of the Constitution to categorise the party as right-wing extremist is "rather futile".
▶️ In its decision, the Federal Office for the Protection of the Constitution had closely followed the guidelines of the Higher Administrative Court of North Rhine-Westphalia and the criteria of the Federal Constitutional Court for the second NPD decision regarding hostility to the constitution.
