Can confirm this - Michigan's AG just mentioned this at a town hall today. They are looking for real employee examples to support their legal challenge.
Is it possible to individually bring suits against all of the DOGE staffers? We know their names, they certainly were complicit in crimes. Why not widen the front and hopefully scare a few of them into new careers out of STEM?
Honestly? Probably not. Most law protects employees of companies who are directed to do things by their employers from
individual consequences for doing it.
In South Carolina, where I live and practice employment law, being fired for refusing to do something illegal does not give rise to a wrongful termination lawsuit unless specific rare circumstances occur.
The way Michigan's AG described it their case will be stronger if they can add specific examples of how the RIFs cause harm. They didn't want to have to wait for any terminations to take place before acting. (I am not a lawyer)
