I agree with @nikostratis.com, we need to be super careful in communicating who this applies to — many countries have visa waiver programs and this doesn’t *seem* to apply to visa waivers. Meaning it will especially target people from global south countries already subject to visa denials/scrutiny.

Even with a visa waiver, you have to get an ESTA. You have to include your sex on the application for that, which must match your passport. But if that doesn't match sex assigned at birth, you end up facing the same fraud provision

Because this is being issued to State Department employees and not Customs and Border Protection, who inspect at ports of entry, I’m not sure we can anticipate that yet. It does seem likely that CBP will issue similar advice. I’d want to wait and see what that is.
