Can you put counter 3 on, put the draw ability on the stack, remove counter 3 from Shiva to play the instant you manipulated to the top, and then draw while keeping Shiva on the field? That would be wild if possible, but I’m not sure about the timing with possible state-based effects.

If you can remove the last saga counter WHILE the trigger for the last ability is on the stack still, then yes, it won’t be sacrificed. But once that ability has resolved, it’s sacrificed as a SBA before you can do anything else. Look to Comp Rule 714.4.

Right, my question was more along the lines of “is noticing the 3rd counter and sac’ing Shiva a single state-based action, therefore binning Shiva before you can respond, or is there a pause between putting the counter on and sac’ing where it can be removed to prevent Shiva leaving?”

The 3rd Saga counter goes on, the ability goes on the stack. While the ability is on the stack, you can react to it at instant speed before it resolves. Once it resolves, it’s sac’d as a State Based Action. So yes, there is an Instant Speed window of time to remove the counter.

I do something similar in my Xavier Sal deck. I manipulate the lore counters with my commander. I run a pretty hefty saga package in the deck. Definitely adding Shiva and more summons to the 99.
