Yes, that is unfortunate. But it is proof that using completely public domain materials is considered feasible. I suppose I should have put the adjective after "1 million." The data set is not public domain. The books being used are.

So this is merely an appropriation of the public domain. They specifically don't want the broader community to benefit from it. If the corpus were a garden it wouldn't just have a wall around it; it would be in a locked courtyard with a roof.

I did a tiny bit of digging and a number of journals (e.g., Wired) breathlessly report that the database will be available to the public, but here's the actual press release. It looks *very* carefully worded to avoid any implication that it will be public access:
