I'll give 2/3 cheers for SCOTUS in upholding the rule of law in Abrego Garcia. Adopting Sotomayor's statement affirming the lawlessness of removal would have been much better. This is yet another Roberts ruling that is technically possible but difficult in practice, especially with an executive operating in bad faith. In other words, another Roberts sleight of hand. Very likely this case ends up back in front of SCOTUS before Garcia is back on American soil.

These two sentences from Sotomayor’s statement are chilling to read: “To this day, the Government has cited no basis in law for Abrego Garcia's warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison. Nor could it.”
