The loss could be quite temporary, as Trump’s bid to fire Dellinger will be reviewable next Wednesday when the district court’s temporary restraining order expires. And only two justices signaled they will oppose the plea when it is fully considered.

Those two justices are Ketanji Brown Jackson and Sonia Sotomayor.

Justices Alito and Gorsuch dissent, saying the TRO is reviewable immediately.

So that means CJ Roberts and Justices Kagan, Thomas, Barrett and Kavanaugh are the five to take the middle position of holding Trump’s application in abeyance until the TRO expires.
