The whole point of a TRO and a temporary injunction is to preserve the status quo while the legal issues are decided. To enter a TRO or an injunction, a court must find that the applicant has a substantial likelihood of success on the substantive merits of their case.

Slight correction. Judicial review of constitutionality certainly began with Marbury v Madison, but judicial review of the constitutionality of presidential authority/acts didn’t come until later in the 19th century. M v M dealt with an act of Congress.
