Prior to 1880, California law held that only white children were entitled to public education. However, the law was changed in 1880 to state that any child could attend public school regardless of race. The Tapes sued and in March 1885 won the right for minority children to attend public school. /2

After the California Supreme Court’s decision in the case, San Francisco’s superintendent of schools urged the state assembly to pass a law establishing segregated schools under the separate but equal doctrine. A new school for Chinese children was established in Chinatown. /3

Mary Tape continued to argue that prejudice is un-American: “I will let the world see Sir What justice there is When it is govern by the Race prejudice men! … just because she is descended of Chinese parents I guess she is more of an American then a good many of you.” /end

Side note: When Mary Tape came to the U.S. at age 11, she likely would have been forced into prostitution. Such was the fate of most Chinese women at the time. However, Mary was rescued and taken in by the nonprofit Ladies’ Protection and Relief Society, where she resided until the age of 16.
