Like any good politician, Romney later turned a loss into a win by co-opting the new law, and to his credit, he actually did a pretty good job of defending it (even including the individual mandate penalty) when he ran for President...but he was pretty much forced into it by a Dem supermajority. 2/

2. Having said that, yes, there are *some* major similarities:

--Both include a state-based private insurance marketplace to enroll

-Both include financial subsidies for lower-income enrollees

--Both included an individual & employer mandate penalty (the ACA no longer has the former)

--Both also include guaranteed issue requirements (ie, insurance carriers have to offer coverage to anyone who wants to enroll as long as they're a legal resident & pay their premiums

Beyond that, however, there are MASSIVE differences, including Medicaid expansion, free preventative services, etc.

The ACA also includes a lot of stuff which may also be state law in MA, but which other states also already had.

For instance, the requirement that adult children can stay on their parents plan was already law in 35 states, although the ages & other criteria varied.

Another example: The ACA requires insurance carriers to spend at least 80% (85% for large group plans) of premium revenue on actual healthcare claims. "Romneycare" set it at 88% in MA since 2006...but New York had beaten them to the punch in 2000:

I was working on the hill at the time the ACA passed. One of the things that gets lost in these discussions is that the alternative to the ACA was not M4A or universal healthcare. The alternative to the ACA was getting nothing.

So much so that when Sanders threatened to veto the ACA if Dems blocked his "amendment" (which was to scrap the whole thing in favor of a single payer plan), it was REPUBLICANS who voted to have the amendment read on the senate floor. Because they knew it would kill the bill just like it did in 93.

If it gives the Aca a patina of bipartisanship and that helps save it, I’m okay calling it whatever they want. Actually, to save it from maga, they’d literally have to call it trumpcare, then he’d say it was the greatest thing ever and they’d fall in line. (See idiotic account names in new bill)
