The main reason no one has implemented the Nemesis system is that it takes a fuckton of resources to get it to work right. No indie is really going to be able to do it. AAA has only seen riffs on the idea like in Assassin's Creed and Warframe. The patent only covers the code implementation.

Look at who they are competing with. ATVI patented a ton of inventions for Guitar Hero to try to put down Harmonix because they backed out of a deal to go with MTV and make Rock Band. Kotick was pissed. Harmonix patented the 3D note highway so ATVI had to make a sprite highway in Tony Hawk engine.
