In the ScotGov vs FWS case on the GRA the ScotGov Counsel has done a shockingly poor job, clearly doesn't fully understand trans people or the impact of GRCs which should be basic expectations of a Government lawyer handling this case. Difficult not to make a case that ScotGov would have been far better off sending a less senior lawyer who actually has any foundations in LGBTQ+ rights rather than the most senior one they had who clearly has none.

This case should have been incredibly one-sided. It wasn't, for no good reason.

Now FWS, an anti-trans hate group, have both managed to secure a major stage to push their hate, lies, and conspiracies against trans people but also have the fumbling, confused defence of a counsel who didn't understand the brief to take advantage of.

Even if its a win it'll be pyrrhic, now.

This, of course, is not entirely on the Counsel (though there's plenty of blame there) - it's pretty difficult to defend a Government position when the First Minister himself doesn't believe in the position being defended, as Swinney repeatedly displays he doesn't care to understand trans people.
