i think from the 14th amendment sec.3 where it disqualifies someone from Senate, Congress, or Presidency if they participate in a coup.

The one time that came before the Supreme Court with Trump (CO refusing to put him on the ballot), the Supreme Court decided he could be on the ballot. Therefore, does not apply unless he is convicted of insurrection. Raging that it’s illegal for him to serve is our version of election denial.

The Supreme Court ruling was that only Congress could move to have him removed. Also, he was found guilty of Insurrection by Congress. He just wasn’t removed from office by the senate. The 14th Amendment applies.

It is illegal because Article 14 section 3 of the constitution prohibits an insurrectionist from holding office. He was impeached for inciting an insurrection.
