seriously. if the constitution cannot recognize racial inequality and mandates strict and formal equality under the law, then what exactly is unconstitutional about a law that requires both whites and blacks to sit in separate train cars?

the constitution, in his view, does not recognize the existence of racial inequality nor does it allow either private or public actors to address it in official acts. this, basically, is the majority’s view in plessy v. ferguson.
