I don't doubt the good intentions, but I'm not convinced this solves anything. The poorest & most deprived people always suffer hardest under the law, because of their circumstances. That inequality will still be there. Does it really make sense to have a more subjective legal system as a quick fix?

This is not a quick fix, the pre sentencing report is created for everyone, regardless of background, to ensure judges have all the facts before they determine the sentence. If anything it redresses balance as we all know the law is the preserve of those who can pay for it.

Please explain if you think I'm wrong, but these sentencing guidelines seem very misguided.

Also it doesn't address the inequalities causing populations to be overrepresented in the criminal justice system in the first place.

That said, I doubt the govt will actually make the changes needed...

they aren’t guidelines on sentence. they are guidelines as to when to seek a pre sentence report from probation (a report which can often result in a more severe sentence). totally different things.

in reality the guideline is just common sense. You are more likely to need a report for a person who has not been in much trouble before than you are for a recidivist offender.

Interesting article - I strongly agree sentencing should be the decision of judges not politicians - and judges should never be threatened.

But this article is mainly a critique of Jenrick's proposals, which the govt has rejected - surely this suggests the govt wants to avert these problems?
