I spoke to a lawyer a few weeks back about this. According to her, LAs have a right to consult any school that might be able to meet need, including sharing paperwork, without parental consent.

I am happy for them to consult, I just want to be told who they are consulting with, it's always fun to get random emails from Independent schools inviting you for a visit as County have shared EHCP, But then when you mention a new diagnosis they say.. Are upfront and honest they can't meet need. Suprised by County sending consults to Independent. Just want to be kept updated.

I'm sure you have the right to know who they're consulting. We didn't ask our LA to consult special schools. But they sent us copies of the consultation letters the day after they sent them to the schools. Including a non S.41 independent school. V surprising!

We've contacted the schools directly to find out if they can meet need. The non s41 told the LA they could, but thar we'd refused a visit. It was like borstal! Then they admitted to us they hadn't reviewed the EHCP properly and couldn't meet need! Some just want the money I think.
