Why wouldn’t Trump make this entire discussion of unconfirmed power moot by simply nominating Musk to a real position. His senate would confirm Musk as they have done with other horrible appointees.

he would, theoretically, be subject to restrictions to which he is not now. In practice, of course he wouldn’t, though. But there would be at least some pretense of him having to follow some laws, unlike now.

Because they might not. No less than Steve Bannon has been talking about how 25% of MAGA is on Medicaid. GOP reps are already shooting down a budget proposal that cuts Medicare and SNAP.
