This is a good reminder, but EOs do allow a president to provide instruction or directives to the admin agencies, who can then promulgate rules that DO carry the weight of law.

I have no idea what admin agency would be used to create and enforce NIL rules, though. (Can’t read the article.)

I think you’re referring to Raimundo, the recent case that undid Chevron (which historically gave agencies deference when creating rules to further laws passed by Congress). That concerns agencies’ relation to Congress, not the White House.

My bad. Yes, the undoing of Chevron. I thought the promise was that when Congress was ambiguous in law, judicial now had to interpret, not the executive. How would that allow the chief executive to make law?

If we survive this 2nd term and anything good comes from it, I hope it is an extremely weakened presidency more in line with how the founders set it up.
