Wait, you're saying there's a court order shutting the podcast down? Because to get such an order, the plaintiffs would have had to have shown that there was some merit to their case...in other words, that it *isn't* just a SLAPP case. Do you have any more details?

Thanks--it sounds like he's explicitly saying that the court did not order him to shut down the podcast, but made some unspecified other order that left him in a position where he felt like he had no choice but to take down the social media. I won't speculate as to what that order may be.

I don't practice in this area, but the general three-part test for interlocutory relief (across most areas of the law) requires that the party seeking the relief show
1. some realistic chance of eventual success at trial,
2. that they would suffer irreperable harm if the relief was not granted, and

3. that the balance of the parties' convenience favours the granting of the relief.

I like the Breakdown, and have no time whatsoever for the UCP, but if a court has granted interlocutory relief, something beyond just a SLAPP suit is likely happening here.

I think interim injunctions in defamation cases use a modified version of the test that requires proof of a strong case (and no available defences?)

Seem to remember a recent case in YYC involving a cop that says prior restraint in defamation cases is only available in exceptional circumstances

I'll add as well (always with the caveat that this is outside my area of practice) that an interlocutory order shutting down the podcast (as distinct from, for example, restraining it from discussing the plaintiff) strikes me as something that I'd expect to be extremely unusual.

If you mean the Premier, she's not a party to the suit (nor is anybody in government or the UCP). You might speculate that she's somehow involved behind the scenes, but I would expect her to currently be having as little to do with the plaintiffs as she possibly could.
