You're stealing a base here. You're skipping the sentence in the Declaration that says governments are instituted among men, deriving their powers from the consent of the governed.
The question is if they're 'subject to the jurisdiction thereof...' as the 14th Amendment states. IMO, they're not. Since they've entered illegally, they have no legal basis for being her, thus aren't subject to our jurisdiction.
