SCOTUS gave habeas rights to "enemy combatants" detained there, but not much else. Abuses were rampant and little recourse existed. The Court has changed and, in some respects, undocumented immigrants might be in a worse legal situation (because of current detention practices).

But, whether the Trump administration succeeds or not, the only purpose of locating a facility at the Cuban base is to avoid legal protections. There's no other reason. And, I assume Trump will argue for the dissenter's position that it is a law-free zone outside of the US. Horrifying. /end
