Perhaps the problem here is I’m talking about what is legally possible and you’re talking about what you think the most workable solution would be. But whatever that is, it’s not true that we “can’t“ ban it.

The grounds for the ban are relevant and arguments about the constitutionality of those grounds are legitimate. It's important too and like all constitutional arguments, the specifics of a particular situation don't negate the supposedly general application of those arguments.
I get that your concern lies with privacy laws, and I certainly wish you luck in promoting them.
But they are not what I’m talking about and I don’t think they would be a panacea for the issues that I’m worried about myself.
