We somehow got Goldeneye, Perfect Dark, Killer Instinct and the Banjo games all on the service so no idea what's holding up DK64. Surely Donkey Kong would be the easiest to get on Switch Online, IP wise. Goldeneye especially had issues with copyright for a long time and eventually got a release!
DK64 is actually kind of a nightmare because it contains the entirety of Jetpac, a game owned by Rare. Whenever Nintendo wants to port DK64, they have to negotiate for that.
While you're correct, I find it very hard to believe that Microsoft is willing to negotiate Banjo Kazooie, Banjo Tooie, and Goldeneye... But not Jetpac...? Lol
Well, I'm no expert, but this is a Nintendo 64 with a whole ZX Spectrum game owned by a competitor hidden inside it. I can't think of anything else like it and I'm sure it's a unique challenge for all involved. They did put it on Wii U, so we know it's not insurmountable.
Oh wow that is a bit ridiculous. But given all the rumours years ago that Rare Replay was supposed to come to Switch, would've thought this would've been sorted out. Copyright issues are kind of stupid for something this old.
The release of DK64 on NSO at this time would overshadow holiday sales. And within the next quarter or two we'll ginally hear about Switch 2.
So to insentivise sales around it, DK64 and similar titles to its notoriety will be released around the time Switch 2 comes out to support purchase of-
Overshadow might admittedly be a strong word to use. However, you have to admit that them holding it back until they felt the need to hype up NOS sales is a move they would make.

It could also be plausible that people who buy into Switch 2 will be rewarded with a program that allows them to play newly added NSO games earlier. Maybe by a few weeks or so.
