Not just in politics but in life, people need to be much more comfortable with the idea that you try stuff and then you discover what the outcomes are and if you are very very clever you are going to be moderately less surprised less often than other people.

You should still try to be very clever! Being less surprised is good, actually as is knowing enough about stats to know that relying on winning the lottery is bad. But life is very big and you are very small that means that overwhelming pessimism is not actually realism.

Without the Archivist doing her thing there's no SCOTUS fight or legal argument whatsoever to be made that the ERA has been ratified.
Trump just goes "We still consider the 2020 DOJ OLC memorandum to be controlling" and that's it. Done.
This never gets to SCOTUS.
