That position (and the organization it leads) was not set in law and as such is absolutely up to the current executive to name or modify as they see fit.
Shouldn't matter, but USDS was hobbled in a lot of ways because it wasn't allowed to use the cloud specifically to avoid cloud providers handing things over if they ever got a subpoena (vs going through OMB FOIA office)
It has been awhile since I was deep in FOIA and am spitballing from memory: OMB is subject to FOIA, and applicability in EOP depends in part on function of office, I think. https://www.justice.gov/archives/oip/blog/foia-update-foia-memo-white-house-records. Trump EO makes clear agency-facing role for DOGE so I think it more like OMB than USDS.
I think that's right - they created a sort of time-limited subagency within it that reports directly to the WH COS. As far as I can tell the rest of USDS, though renamed, keeps on keeping on?
Interesting too that the EO seems to limit DOGE to modernizing software and technology. Which is not such a terrible idea - but seems to be very different than what Mr Musk thinks his mandate is. Not $2 or even $1 trillion in savings there!
