I think they do? Not a ferpa expert, but there is a very specific process by which the federal government can get educational records, and this doesn't seem to fit within any exception. https://www.ecfr.gov/current/title-34/subtitle-A/part-99#99.31

FERPA is under the Office of the Chief Privacy Officer. All I could find was a “what if” article.

No idea if ED is still going to pursue Ferpa enforcement. The executive order can't repeal FERPA, but the article seems right that the primary enforcement mechanism is through ED. It'd be dumb for schools to violate the law just because ED isn't enforcing it, but schools can be dumb sometimes.
