CMA launches legal challenge to Alberta law limiting access to treatment for #transgender youth. Bill 26 bars docs from prescribing puberty blockers, hormone therapies to those under 16, by @kkirkup.bsky.social @alannasmith.bsky.social www.theglobeandmail.com/canada/artic... @theglobeandmail.com

If “conscience rights” in the Charter allow certain doctors to treat these patients as CMA argues, then other doctors can refuse to treat those same patients, or even refuse to give vaccines. Conscience!!
This is how evidence-based medicine dies.

If so, can’t Alberta merely defund it or does that then fall under CHA?
That is a complicated question about defunding and CHA. Depends on: (1) what the interventions are and (2) whether they are discriminatory withheld under s. 15 of the Charter and Alberta human rights law.
Thank you for this - I’m not a lawyer - looking at it differently is so useful.
We have a universal definition of care and expectations in Canada.
Drs, with many years of training, should he the only ones making medical decisions. Medical policy should not be made by populist politicians with no medical background.
