Also, in what must be an ICC first, the charges include attacks on "persons whom the Taliban perceived as not conforming with their ideological expectations of gender identity or expression."

It's definitely a new development! The ECCC found that Sou Sotheavy (a transgender woman) was a victim of forced marriage policies alongside many cisgender Cambodians, but otherwise there's very little intl criminal caselaw
There was a mention in the 2019 #Myanmar #Rohingya investigation authorisation of sexual violence against 3rd-gender, trans women & intersex persons. (Para. 86)
