The state of Texas only has jurisdiction within the state, not between the states as that is the purview of the federal government. Intrastate versus interstate commerce.

commerce and it requires the provider be licensed to practice / prescribe in the location where THE PATIENT is, not where the provider is.
I had an eye exam and is was telehealth. The Dr. was in a different state. How does this work for specialty treatment where patients HAVE TO travel out of state.
I guess it is not the United States. Everytime someone buys a gun in Texas and delivers or ships it to another state, I guess those state’s attorney general can sue?

And this Texas suit will be a test of that law. How many creative ways can Texas harass someone who is not a Texas resident? Will having your home state on your side be enough? And suppose the Feds pick a side?
Commerce Clause has nothing to do with practicing telehealth. What am I missing here? The doc is not licensed in TX, which means she can’t provide telemedicine in TX. Doc did the moral thing, but is legally wrong.
But the question becomes is practicing telehealth across state lines considered interstate commerce thus triggering the commerce clause? Also Ken Paxton has no jurisdiction over the state of New York.
Because the patient is receiving services in NY! That is where the doc is licensed !! If TX wanted to go after HER , I guess they could , but the doc has no liability there. People travel for treatment all the time.
Doctors are licensed and regulated mostly by the states. Paxton is an evil fuck who should rot in hell, but it's not outside of the realm of reason to argue that this non TX-licensed doc was treating a woman who was in the state of Texas. I hope it plays out for the good guys, but it's not crazy.
Paxton is the biggest crook and should be in prison if it werent for corrupt Texas politicians letting thatbprick off the hook. He’s been emboldened even more. God help TX women
