Big deal. Big deal, big deal. Ho is a former ACLU lawyer. Clement is among the anointed in the conservative legal world. I doubt Ho will eventually refuse the DOJ's request. But this will dig deeper into what happened and extend the process. The choice of Clement is important.

If Ho doesn't refuse the DOJ's request, it's nothing but performative.
DAG Bove is going to hate this investigation. He will have to answer some uncomfortable questions as an "officer of the court". If he lies he can lose his law license.
Ho didn't need to "keep options open." He could have just said no, you can't dismiss this.
Of course Bode will make weak arguments. He will also have to explain a lot of uncomfortable details, like why he is the only one who showed up for the hearing because all the prosecutors quit rather than sign onto the dismissal.
What he's done is set it up to make it LOOK like he did something, when he really set it up to fail.

He’s building a process to (1) expose what happened, (2) help him reach the correct result in an unprecedented situation, and (3) make a complete record that will withstand an appeal.
