Obviously insofar as practicality is concerned, I'm not causing damage to TPC by using their art without consent, but kinda logically it's the same thing? I've commissioned art a couple of times for the channel at this point, but not every video needs a stylized thumb like that. I only do it when I have a specific vision that I DEFINITELY cannot execute on.

As an artist, who has made thumbnails both from completely original art and from in-game images (from games with much smaller IP than TPC), my take is that the art people use in YT thumbnails are art the devs intentionally put out to be used by media… (1)

You taking a PNG of dunsparce or something and putting it on a YT thumbnail is the same as IGN using the same image on an article. It ultimately grabs attention and advertises the game, so TPC won’t care that it’s being used that way. (2)

TPC or any game company knows their images will be used and and pseudo-consent to that being out in the world. Artists cannot consent to AI being trained from their work. (3/3)

Id say screenshots and use of stock art is generally considered to be courteous & appropriate. To me, using a game screenshot to document gameplay is like using a photograph you yourself took?
An art piece is as much its context as its literal pixels
Stock art especially is Meant to be used this way

there's also the issue of attribution i think. it's possible to credit "hey this art comes from TPC" or even the actual illustrator if they list that, but with AI it's just not possible to credit the artists whose work was used

the issue isn't using it, but using an image that isn't mine and also profiting off of it. Like, yes, the substance of my product is the video, which I write and edit and is absolutely fair game. But the thumb is part of how I get views

Part of how I view using official art too is that if I am using it to create something of my own and convey a unique message, it nets to something unique/creative. GenAI more or less pieces stuff together based on its training data without having a distinct creative vision like a human might.
