Check out Bush v Gore in which the Supreme Court plucked a case out of the Florida court system and stopped a recount resulting in Florida's electoral votes and the 2000 presidential election going to George Bush.
What’s the basis for the direct path to SCOTUS vs to a US district court? (Or is it just that the defendant asked and given his status SCOTUS dropped everything to answer?) In retrospect, maybe the better path for defendant would have been to ask Judge Cannon in FL?
Agreed.. I would think that they have no sway in a State Matter but would obviously in a Federal. Beyond that, they in their earlier ruling defined zero exception to private matters outside the presidency-clearly this fits that carve out.
I hate that making him follow the law like everyone else is "politically charged" but actively trying to subvert the system to find loopholes and trampling precedent to keep him from facing justice is not political somehow.
And so, after Donald was found guilty of committing 34 felonies, tomorrow he will attend his sentencing "BY VIDEO" and be sentenced to... nothing.
Justice 🤔
In NY an order to show cause (OSC) is a shortcut to begin a motion which may then be responded to. If the judge declines to sign your OSC, you can still commence a motion with a notice of motion that triggers a standard timetable for a hearing and answer under the Civil Practice Law and Rules.
SCOTUS is 100% in his back pocket, and even if they weren't, the judge has already said no punishment will be dealt. We know what he did, but it won't make any difference to his followers. "I could stand in the middle of Fifth Avenue and shoot somebody, and I wouldn't lose any voters, OK?"
In NY, the Supreme Court is actually the trial court. The Court of Appeals is the highest court in NY. The Appellate Division is the “intermediate” court.

We now await a decision from the United States Supreme Court, where Trump has a pending application to halt his sentencing.

I'm guessing it won't take months this time.

Here sir, one serving up of justice for you to consume. Long time coming, yet before any immunity can apply.
Frosting on the cake, a state court ruling.
