The process seems clear if Judge Breyer retains jurisdiction. But if it turns out he doesn't, what then? It stays in the Ninth Circuit which was only appealed to on the TRO?
How can we ever establish a quantum of evidence to justify the judicial review that supposedly exists without a hearing?
We know that Trump does not accept lower court rulings if they are not in his favor. 👨⚖️
