I'd add in Ontario where I am the law is different. Our bulk sales act allows for the contract to be "with or without seal", so the question is moot here. But wow the Saskatchewan Court of Appeal spilled a lot of ink on the issue. Ok I should be working.

I guess if you are going by the strict letter of contract law it does constitute an agreement. But then me waving and jumping up and down would do that as well and that doesn’t count.

I think it depends on the previous interactions. If, in past discussions, you have accepted contract terms by texting "yup" or "for sure," it's absolutely reasonable for the other party to consider thumbs-up as an agreement.
Don't get too casual in your business deals, and this won't happen to you?
