You can not legally purchase a firearm, even in a private sale with no record, unless you could have passed a background check. If I sell a gun to a felon, I'm going to prison with him.

I only lived in the US for a few years and that was in Boston, so guns were only seen on cops.

Since returning to Europe, I have seen documentaries where people bought guns from dealers at fairs and stores without ID.

If it’s not generally the case, so much the better.

It is possible to do that and not illegal per se, as you say. It's called the individual sales exemption and it is a seismic issue for both sides, though that may not always be so obvious. The exemption needs to stay intact, and it will.

The problem is that the US has a global arms market, their own forces are over supplied just in case. Look at the stockpiles left in Afghanistan. There was a magnitude more small arms than both coalition forces and the Afghani army could use.
