Remaining silence is not necessarily good advice anymore. You have to positively assert your fifth amendment rights to prevent them from drawing negative inferences.

Actually, this advice came from an attorney. I’m talking about nervous comments during arrests when your adrenaline is up and you aren’t thinking carefully about your words, or when you call someone to come get you. It’s recorded, played in court, and used to make you sound guilty.

I’m not even suggesting you say nothing at all. You can give your name, be cooperative so that you stay safe. But you don’t have to discuss the protest or your presence there in any detail with police or on your phone call. People can forget those moments are all recorded and used against them.

Whenever you are arrested, Miranda Rights even "suggest" you remain silent, because everything you say WILL be used against you. Best to have legal representation before uttering anything other than your name

We were not discussing being a witness at a trial which is different from when you were first arrested.
The OP was talking about if picked up while protesting.
Pleading the 5th during a trial whether a witness or the defendant is practically a confession without admission.

We are both talking about when you are first arrested.

It is important to positively assert your fifth amendment rights. Simply staying mute is not enough
