We did this in the UK. The private sector loaded up these companies with debt, and then they will be sorted out by the government when it goes bust and then the government will sell it off again to the private sector and it will all start again.

I had a slightly different read of the opinion. My takeaway is that it is up to EPA to set the appropriate limits for a discharger and not fallback on general ‘end result’ language. So essentially, the agency needs to get tougher and use more thorough science to ensure water quality is good.

The challenge is that like many regulatory laws when deregulated, the onus falls on the agency to find and enforce- there is no proactive standing protection. Polluters can wreak massive damage until found and then use cases back to the SC challenging prosecution for years.

Apologies if I wasn’t clear. The agencies are the appropriate party to find and enforce, but that only happens retroactively, and now with the agencies being hamstrung by firings, we can’t expect real enforcement in any measure. It’s quasi free reign for pollution at this point.

Me, too. The decision, in my opinion, is not what it is being made out to be here. They seem to be clarifying some language and making the EPA state on the front side what the limits are. The EPA and the State typically evaluate the water quality of the body being discharged into for limit amounts

I guess the Clean Water Act of 72 is dead. I worked in the waste water industry. I can tell you, that our water was "cleaner" than the DNR regulations required. Because of the pride we took in our careers, we would NOT say "fuck it," to the environment.
