I'm not a lawyer but I think the E Jean Carroll case was a civil suit where the language is more vague because the burden of proof is more loose. Which doesn't mean Trump isn't a rapist but it might mean that he can sue because reasons.

Penetrative of one's body by anything (body part or object) without consent is rape, regardless of genders. Sexual assault can be penetrative or unwanted contact. Other assaults (simple, aggravated , etc) don't involve sexual contact.

The judge in that case made clear that, though Trump was found liable for "sexual assault" in this civil case, it is indeed still "rape" in common parlance.

ABC should have fought. They would have won, imo.
