We know from a Bukele tweet that the Trump admin has sent 252 Venezuelans to a Salvadoran jail.

From a leak to CBS News, we have names of 238.

For the other 14: not even their names.

No official info or acknowledgement. This is textbook enforced disappearance.

Enforced disappearance is defined under international law as (1) a deprivation of liberty; (2) with gov involvement; (3) followed by refusal to acknowledge the detention or by concealing their fate or whereabouts. The result is the disappeared person is placed outside the protection of the law.

Everyone sent to be imprisoned in El Salvador is forcibly disappeared. The US gov won’t say where they are. El Salvador won’t say where they are. We haven’t heard from them. In Salvadoran max security prisons (where we *assume* they are), there are no visitors, letters, or phone calls.

I have aseen a lot of journalists, academics, and lawyers grappling with what appears to be a new practice (enforced disappearance of migrants) and struggling to know what to call it. Is it human trafficking? Kidnapping? Abduction? These are all serious but distinct crimes.

But they’re also crimes that don’t include state action as an element. Nor do they address the DISAPPEARANCE aspect (we don’t know where they are & can’t contact them). What is new is that DHS has been employing these disappearances further into the interior, and people are starting to notice. Turns out, you can’t keep justifying more tax dollars spent on beefing up border patrols ability to violate human rights at the border and assume the interior will be safe.

This is mostly premised on "deportation" to a "safe" 3rd country, right? Why aren't there TROs or injunctions about the very practice?

Is "deportation" to a [often 3rd country] torture prison completely novel?

As bad as Miller ("Trump") 1.0 was, the baby jails and jailhouse theater was ostensibly to detain pending removal, right? How did we move to *PUNISHING* so-called deportees with torture or a death sentence?

Miller tried to do it before courts could weigh in. But why haven't they stopped now?
