There is a legal record when a person is convicted of a crime. It is not something for which there is "a lot of evidence,"

The judge denied bond. He appealed and the Board of Immigration Appeals denied the appeal.
So no conviction. That's all it took apparently.

The gov is claiming that since he didn't take it to the 4th circuit of appeals that the court has to accept the accusation he's a member as final and that he has no right to dispute it.

the Board of Immigration Appeals, which affirmed it as not clearly erroneous" to bolster their claim, as a non lawyer, I don't really find that to be a glowing recognition that much fact finding occurred during these hearings.
