Accordingly, our Constitution now demands that “equality of rights under the law cannot be denied or abridged by the United States or any state on account of sex.”
The ERA is now the 28th amendment to our Constitution. It’s a good day.

that's not true, the only things that need to be done is to meet what the Constitution says in article 5, which it already did. archivist is a formality
I'm pretty sure it is already. As I understand it, the publication is for notification purposes. President Biden did the notification. The law was already ratified
The #ERA forbids discrimination against trans people, as it says equal rights can’t be denied on the basis of sex. I don’t doubt lawsuits could challenge that, but the amendment’s wording seems clear.
Constitution says nothing about archivist needing to do anything, all Constitutional requirements have been met and that is the basis for this Constitutional amendment becoming law. PS you can read the constitution online too
The Roberts Supreme Court does not care much for what it says in the Constitution. Sadly neither do the millions of women that sent a rapist to the White House for a second time.
”The executive branch doesn't have a direct role in the amendment process, and Biden is not going to order the archivist to certify and publish the ERA ... the archivist's role is "purely ministerial" in nature, meaning that the archivist is required to publish the amendment once it is ratified” 😬
I believe it technically has passed, and the archivist doesn't have any role in making it official...but the confusion over it worries me bc the GOP will likely challenge it, let's all hope this stands🤞🏼🤞🏼🤞🏼
It doesn’t say you cannot. Regardless, SCOTUS held in Coleman v Miller 1939 that a proposed amendment to the Federal Constitution is considered pending before the states indefinitely unless Congress establishes a deadline by which the states must act. I’m in favor of the amendment. It died in 1982
No, the Equal Rights Amendment (ERA) has not been ratified. Although it was passed by Congress in 1972, it failed to gain ratification by the required number of states within the original deadline set for its ratification, even though some states have ratified it in subsequent years.
His opinion doesn’t really mean Jack Squat.
“President Biden on Friday declared that he considers the Equal Rights Amendment to the Constitution "the law of the land," a surprising declaration that does not have any formal force of effect”.
