sure, if you want to use those models outside of FFXIV without the game, in like, blender or something to create animations, with custom skeletons only, then no software issues are involved, then it's just copyright because they're based on ffxiv

regardless of how you do it or what you do with them, it's a legal gray area, this is not a judgement on the amount of work that goes into it, just a note that there is no such thing as an ffxiv mod that is legal to sell without repercussions
All of the above are in a legal gray area, so its really up to the discretion of those who mod or create mods if they want to ignore the risk. Not sure why comms are better than access to you, when they both serve the same purpose except one can be more exclusive to a singular person
Comms are different because you're directly paying for someone's labor - they're not selling you a digital product based on something they don't own the rights to.
That is the exact reason that fanart commissions can exist for companies that prosecute artists selling merch.
