I think they see it just fine

Barrett and other conservatives don't seem to see how state-sanctioned discrimination against trans people basically always takes the form of sex discrimination—imposing unique restrictions on people's rights based on their sex assigned at birth. Frustrating that the argument isn't breaking through.

Conservative legal doctrine isn’t rooted in a failure to See Things the Right Way. This is about power, they will protect and expand that power wherever and however. It doesn’t mean they don’t get it, and it doesn’t mean they are being inconsistent - they’re adhering to the 1st Rule of Might Club.

Pre-Obergfell the argument was bans on same-sex marriage were gender neutral because both sexes were banned from marrying their same sex. But turn that around and a man is banned from marrying someone a woman can marry. That’s clearly discrimination based on sex now.
